The Committee on Health and Human Resources moved to amend the
bill on page two, following the enacting clause, by striking out
the enacting section and inserting in lieu thereof the following:
"That §30-5-1b, §30-5-12, §30-5-12b and §30-5-16b of the Code
of West Virginia, 1931, as amended, be amended and reenacted; that
said code be amended by adding thereto a new section, designated
§30-5-12c; that §30-5-29 of said code be amended and reenacted;
that §30-7-15c of said code be amended and reenacted; and that
§60A-3-308 of said code be amended and reenacted, all to read as
follows:"
On page fourteen, section one-b, following line two hundred
forty-one, by inserting the following:
"(31) "Practice of Pharmacy" means the interpretation,
evaluation, and implementation of medical orders; the dispensing of
prescription drug orders; participation in drug and device
selection; drug administration; drug regimen review; the practice
of telepharmacy within and across state lines; drug or drug-related
research; the provision of patient counseling; the provision of
those acts or services necessary to provide pharmacist care in all
areas of patient care, including primary care and collaborative
pharmacy practice; the responsibility for compounding and labeling
of drugs and devices (except labeling by a manufacturer, repackager, or distributor of non-prescription drugs and
commercially packaged legend drugs and devices); proper and safe
storage of drugs and devices; and maintenance of required records."
And renumbering the remaining subdivisions.
AND
On page thirty, section twelve-c, following line thirty-six,
by inserting the following:
"§30-5-29. Collaborative pharmacy practice continuation.
Pursuant to the provisions of article ten, chapter four of
this code, pharmacy collaborative agreements in community settings
shall continue to exist until the first day of July, two thousand
eight ten, unless sooner terminated, continued or reestablished
pursuant to that article."
